Wal-Mart has fired back at a personal injury lawsuit filed by Tracy Morgan because the company says the comedian wasn't wearing his seatbelt when he was involved in a car crash earlier this year.
In June, a Wal-mart truck struck the limousine Morgan was traveling
in on the New Jersey Turnpike. The actor was hospitalized in critical
condition with a broken leg and rib, and his friend James McNair was
killed.Morgan believes Wal-Mart is negligent because the truck driver, Kevin Roper, was not monitored for fatigue after driving hundreds of miles from his home in Jonesboro, Ga., before going to work for Wal-Mart on the day of the fatal crash.
In response, Wal-Mart claims the star's injuries and those of others hurt in the crash were caused, in whole or in part, "by plaintiffs' failure to properly wear an appropriate available seatbelt restraint device."
In addition, "By failing to exercise ordinary care in making use of available seatbelts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs' own best interests."
In August, Morgan's lawyer said the star was still recovering from the major car crash. His attorney Benedict Morelli told "Today," "He's still struggling, but he's a fighter and he's had issues before that he's fought through and he's fighting hard..."
